The Missouri Department of Social Services July 1 proposed to rescind a regulation on the Medicaid Managed Care Organization Reimbursement Allowance for excise tax purposes. The rule established the formula for determining the reimbursement allowance that each Medicaid Managed Care Organization was required to pay for the privilege of engaging in the business of providing health benefit services in Missouri, as required under state law. The proposal includes measures to rescind the rule as the Managed Care tax as defined in the statute didn’t meet the broad-based and uniform definition that was federally required.
